Alien Labor Certification

Employers who wish to hire foreign citizens to work for them in the United States are required to obtain an Alien Labor Certification from the Department of Labor. The Kentucky Department for Employment Services is responsible for processing the initial development of the documents required for these certifications and for determining that qualified US workers have been recruited for the position and that none are available.        Dislocated Worker Program

The Dislocated Worker Program helps dislocated workers find and qualify for new jobs. Workers who have lost their jobs and are unlikely to return to their previous industries or occupations are eligible for the program. This includes workers who lose their jobs because of plant closures or mass layoffs; long-term unemployed persons with limited job opportunities in their fields; and farmers, ranchers and other self-employed persons who become unemployed due to general economic conditions. Under certain circumstances, States may also authorize service for displaced homemakers. 

It is part of a comprehensive approach to aiding workers who have lost their jobs that also includes provisions of the Worker Adjustment and Retraining Notification (WARN) Act and the Trade Adjustment Assistance (TAA) program. The programs are designed and operated at the local level, where the decisions about who can be served and which services will be offered are made based on local labor market needs and opportunities, and available resources.

     Enterprise Zone Program

The Enterprise Zone Program provides a substantial tax credit to businesses that locate or expand their operations in areas designated as state Enterprise Zones. To receive the tax credits, the employer must hire a percentage of new employees from certain groups of job seekers.  DES helps such employers meet their obligations to hire from these targeted groups by referring eligible job seekers to the employer for job openings listed with DES.  Additionally DES is responsible for conducting employer orientations as well as certifying  employees eligibility.

Federal Bonding

The Federal Bonding Program provides fidelity bonding insurance coverage to ex-offenders and other high-risk job applicants who are qualified, but fail to get jobs because regular commercial bonding is denied due to their backgrounds.

"…this innovative activity delivers a unique helping service that is not duplicated by any other program in the U.S. to secure the job placement of ex-offenders and other high-risk job applicants…..by providing employers with a special incentive to hire the hardest-to-place jobseekers." "It has a proven track record…" U.S. Department of Labor, Training and Employment Information Notice No. 5-98, August 3, 1998.

Federal Contract Job Listings (FCJL)

All employers who have contracts (or subcontracts) with the Federal Government of $25,000 or more are required by federal law to list their job openings with the state employment agency in the state where the job openings exist. These employers are required to use affirmative action in hiring certain veterans to fill those job openings and must file an annual report with Veterans Employment and Training Services (VETS) showing the number of Vietnam-era and special disabled veterans on their work force. 

If you are an employer with a federal contract, the Kentucky Department for Employment Services (DES) will assist you with meeting your recruitment requirements of the Federal Contractor Job Listing. Because DES is responsible for administering the Veteran’s Employment and Training Program, veterans automatically receive priority in referral on all job openings. As an employer you will greatly benefit from hiring hard working, disciplined, job-ready veterans who bring valuable skills and experience in the latest technology to industries and businesses like yours each day.

Kentucky Works Program

Working in cooperation with Department for Community Based Services' case managers, DES staff in the Kentucky Works Program assist welfare applicants and recipients to obtain employment which leads to self-sufficiency. Incorporating a "work first" philosophy, applicants for welfare must register for employment with DES and attempt to obtain suitable employment before they are deemed eligible to receive benefits. DES staff conduct an assessment of each program participant's employability and based upon that assessment provide customized services including intensive job search assistance, job seeking skills workshops, referral to non-paid work experience, and placement in on-the-job training. Employers who hire employees from this program are eligible to receive certain types of tax credits.         Migrant Seasonal Farmworker Program

The Migrant Seasonal Farmworker Program has two components. They are the Agricultural Recruitment Program (domestic workers) and the H2A Program  (nonimmigrant alien workers).  The Department for Employment Services has responsibility for these two programs in Kentucky.

North American Free Trade Agreement/Trade Adjustment Assistance (NAFTA/TAA) Program


The NAFTA/TAA program provides assistance in the form of reemployment services, training and job readjustment allowances to individuals whose unemployment is linked to increased imports of foreign-made products and relocation of business establishments from the United States to other countries. 

If the loss of your job was due primarily to increased imports you may be eligible for benefits or training under the Trade Adjustment Assistance Act or the North American Free Trade Agreement. In times of very high unemployment rates, when the national unemployment reaches 10% or above, extended benefits may also be available to individuals who use up all of their regular unemployment insurance benefits without locating a job.  In Northern Kentucky contact Dede Dollar, for other areas of Kentucky you may contact Kathy Gullett or Melissa Wiley TAA, NAFTA/TAA Coordinator, Department for Employment Services at the following address.
